6. If the Seller, at any time including after development of the contract, thinks about the credit of the Buyer unsatisfactory the Seller might: (a) need security for payment of the Purchase Cost. 13. 14. If the Purchaser needs special packing in relation to the Product it need to be accepted in writing between the Buyer and the Seller, and the cost of the same is to the Buyer's account and appropriately will be consisted of in the Purchase Price. If the Seller fails to include the cost of special packing in the Purchase Cost the Purchaser should pay to the Seller such expenses as needed.
Where installation is consisted of in the contract the arrangement of a clear working site and sufficient access will be the duty of the purchaser. It is our normal practice to inform shipment beforehand in order to help with the clearance of our working area. We reserve the right to make an examination of the workspace, and to postpone carrying on to site at no penalty to the Seller if inadequate gain access to or facilities exist 16.
In the case of structures which need website welding a 3 phase supply with sole access and effectively preserved voltage is also the obligation of the buyer. We will more than happy to talk about any difficulties in the provision of these requirements and make alternative provisions if required, however unless otherwise concurred in composing, any additional expenses will be to the purchaser's account.
It is normal procedure to bolt racking structures to the floor, and unless otherwise, our quotation makes allowance for this. However, if the flooring piece is strengthened with grid steel mesh or comparable materials to a level less than 70 mm listed below the surface area, special drilling devices will be required and any extra expenses incurred will be to the buyer's account.
Unless mentioned in composing our quotation presumes an affordable condition of flatness of flooring. Flatness tolerances should be within + 3 mm inside a 3 metre radius. Additional costs incurred in compensating for a defective or uneven flooring will be to the buyer's account. 19. We schedule the right to assign or subcontract out the entire or any part of this contract at our discretion.
At any times priced quote for our completion or delivery work from the date of invoice by us of a composed order to continue, together with all information and details we require to proceed with the manufacture without interruption or hold-up. All such times are to be dealt with as price quotes only and we will not be liable for failure to dispatch, set up, or otherwise perform within such times unless otherwise concurred in writing.
21. The Buyer shall pay the Seller immediately. If the Purchaser stops working to make a payment by the due date, the Seller may, without notice, withhold shipment of any further Product to the Buyer and might terminate, without liability to the Purchaser, any or all surviving agreements between the Seller and the Buyer.
If payment is not made on the due date, the Seller might charge interest on the amount payable at the rate of 5% over the 90 day bank bill rate relevant on the day the payment is due. 23. The Purchase Rate is not inclusive of items and services tax, unless otherwise specified in writing.
